Terms of Service
Last Updated: September 17, 2026
Welcome to ERF Shipping. These Terms of Service (“Terms”) govern your access to and use of our website and your purchase of shipping containers, modified containers, container conversions, accessories, delivery services, and other products or services offered by ERF Shipping.
Throughout these Terms, “ERF Shipping,” “we,” “us,” and “our” refer to ERF Shipping. “Customer,” “you,” and “your” refer to any person or entity accessing our website, requesting a quotation, placing an order, or purchasing products or services from us.
By accessing our website, submitting an order, requesting services, or purchasing from ERF Shipping, you agree to these Terms and any policies incorporated into them.

2. Eligibility to Purchase
By placing an order, you represent that you are legally capable of entering into a binding transaction.
If you purchase on behalf of a business or organization, you represent that you have authority to enter into the transaction on its behalf.
You are responsible for providing accurate and complete information when placing an order.
3. Product Information
We make reasonable efforts to present accurate descriptions, specifications, dimensions, images, availability, and other product information.
Shipping containers, particularly used containers, can vary in appearance and condition.
Images displayed on our website may sometimes be representative of a particular container type, grade, configuration, or model rather than the exact individual unit ultimately delivered, unless the listing or order expressly identifies the photographed unit as the specific unit being purchased.
Colors may also appear differently depending on lighting, photography, display settings, previous use, repairs, and weathering.
4. New and Used Containers
The condition of a shipping container depends on the condition or grade stated in the applicable product description, quotation, or order.
New or one-trip containers may still display minor cosmetic characteristics resulting from manufacturing, handling, transportation, or their initial journey.
Used containers have previously been in service and may show normal signs of use, including:
- Dents
- Scratches
- Surface rust
- Paint fading
- Previous markings
- Patches
- Repairs
- Floor wear
- Cosmetic imperfections
- Variations in color or appearance
Such characteristics do not necessarily constitute defects where they are consistent with the container’s advertised condition or grade.
5. Container Dimensions
Container dimensions, weights, and capacities displayed on our website may be approximate or based on standard industry specifications.
Actual measurements can vary slightly depending on the manufacturer, container age, design, modifications, and other factors.
Customers requiring exact dimensions for a specific project should confirm applicable specifications before ordering or before modification work begins.
6. Pricing
Prices are displayed in the currency indicated on our website or during checkout.
Prices may vary according to container type, size, condition, availability, modifications, accessories, delivery destination, transportation requirements, and other factors.
We reserve the right to change prices for future purchases.
Once an order has been accepted at an agreed price, subsequent website price changes will not ordinarily change that agreed order price unless the order itself is subsequently modified.
7. Pricing Errors
Despite reasonable efforts to maintain accurate information, pricing or product-information errors may occasionally occur.
If a material pricing error is identified before fulfillment, we may contact you to explain the issue and available options.
If an affected paid order must be cancelled, the applicable payment will be refunded.
8. Payment
Payment is subject to our Payment Policy.
All currently accepted payment methods are displayed at checkout.
Unless different terms are expressly agreed upon, payment must be successfully completed or authorized before an order can proceed to fulfillment.
Orders may be held for verification when reasonably necessary for payment security or fraud prevention.
9. Order Acceptance
Submitting an order does not necessarily constitute final acceptance of that order.
We may review an order for matters such as:
- Product availability
- Pricing accuracy
- Delivery feasibility
- Payment authorization
- Transaction verification
- Custom modification requirements
- Suspected fraud
- Other material order details
We may contact you if additional information is reasonably required to complete your order.
10. Order Confirmation
After placing an order, you may receive an electronic order confirmation.
Customers are responsible for reviewing their order information and promptly notifying ERF Shipping of material errors.
An automated order confirmation does not necessarily mean that the product has been dispatched.
11. Custom and Modified Shipping Containers
ERF Shipping may offer modifications including:
- Windows
- Personnel doors
- Roll-up doors
- Electrical installations
- Lighting
- Plumbing
- Insulation
- HVAC systems
- Ventilation
- Flooring
- Shelving
- Partitions
- Painting
- Branding
- Security features
- Office conversions
- Workshop conversions
- Storage conversions
- Other structural or cosmetic modifications
Customers are responsible for reviewing and approving applicable specifications before custom work begins.
12. Customer-Approved Specifications
For customized containers, customers should carefully review applicable dimensions, layouts, drawings, colors, materials, accessories, electrical requirements, door positions, window positions, and other specifications before providing approval.
Changes requested after modification work begins may result in additional charges or additional completion time and may not always be possible.
13. Shipping and Handling
Shipping is governed by our Shipping Policy.
Our standard handling time is generally:
1–4 business days
Our standard total estimated shipping timeframe is therefore:
3–9 business days
These timeframes are estimates and are not guaranteed delivery dates.
Customized containers may require additional production or modification time before the standard transit period begins.
14. Delivery Requirements
Shipping containers are oversized and heavy products requiring specialized delivery equipment.
Customers are responsible for ensuring that the delivery location is reasonably suitable and accessible.
The customer should consider:
- Road access
- Gate width
- Overhead clearance
- Trees
- Buildings
- Fences
- Utility lines
- Ground conditions
- Turning space
- Unloading space
- Delivery-equipment requirements
Customers must disclose known access restrictions before delivery.
15. Delivery Site Preparation
Unless expressly agreed otherwise, the customer is responsible for preparing the delivery site before the container arrives.
The intended placement area should be reasonably level, stable, accessible, and capable of supporting the container.
ERF Shipping is not responsible for site preparation unless such work has been expressly included in the customer’s order.
16. Failed Deliveries
If delivery cannot be completed because of inaccurate information, inadequate access, unsuitable site conditions, undisclosed restrictions, or another circumstance attributable to the customer, additional transportation, storage, redelivery, or handling costs may apply where permitted by law.
Customers should contact us before delivery if they are uncertain about site accessibility.
17. Delivery Inspection
Customers should inspect the container as soon as reasonably practical after delivery.
If significant transportation damage, an incorrect product, or another material problem is discovered, please document the issue with photographs or video and contact ERF Shipping promptly.
18. Delivery Delays
Delivery delays can occur because of circumstances outside our reasonable control, including:
- Severe weather
- Traffic disruptions
- Road closures
- Carrier availability
- Mechanical breakdowns
- Natural disasters
- Government restrictions
- Emergencies
- Other transportation disruptions
When we become aware of a material delay, we will make reasonable efforts to provide updated information.
19. Returns
Eligible returns are governed by our Returns & Refunds Policy.
Our standard return period for eligible products is 30 days from delivery.
Customers must contact ERF Shipping before arranging the return transportation of a shipping container.
Because containers require specialized transportation, customers should not independently send a container to an ERF Shipping location without receiving appropriate return instructions.
20. Refunds
Approved refunds are processed within 10 days in accordance with our Returns & Refunds Policy.
Refunds will generally be made to the original payment method unless another method is necessary or agreed upon.
Banks and payment providers may require additional time after we process a refund before funds appear in the customer’s account.
21. Custom Product Returns
Customized or substantially modified containers may have different return eligibility where permitted by applicable law because they may have been produced specifically according to customer-approved specifications.
This does not eliminate rights or remedies that may apply where a product is defective, materially misdescribed, or materially fails to conform to agreed specifications.
22. Order Cancellations
Customers wishing to cancel an order should contact us as soon as possible.
Cancellation may become more difficult after:
- A container has been allocated to an order
- Transportation has been scheduled
- A container has been dispatched
- Custom materials have been purchased
- Modification work has begun
Any applicable cancellation costs or restrictions will be handled in accordance with our Returns & Refunds Policy and applicable law.
23. Ownership and Risk
Ownership and risk associated with purchased products will transfer according to the applicable transaction, delivery arrangement, and requirements of law.
Nothing in these Terms is intended to eliminate rights or obligations that cannot legally be excluded.
24. Customer Responsibilities
Customers are responsible for providing accurate:
- Contact information
- Billing information
- Delivery information
- Site-access information
- Product specifications
- Modification requirements
Customers are also responsible for reviewing their order details before completing a purchase.
25. Permits and Local Requirements
Depending on the intended use and location of a shipping container, local authorities may impose zoning, building, planning, electrical, plumbing, structural, environmental, homeowners’ association, or other requirements.
Unless expressly agreed otherwise, the customer is responsible for determining what permits, approvals, inspections, or other authorizations are required for the placement or intended use of a container.
Customers should consult the appropriate local authorities or qualified professionals where necessary.
26. Intended Use
Customers are responsible for ensuring that purchased products are suitable for their intended use.
A standard shipping or storage container should not automatically be assumed to satisfy requirements applicable to permanent residential, commercial, industrial, or other regulated structures.
Any required structural, electrical, plumbing, fire-safety, accessibility, or building-code compliance should be determined based on the intended project and applicable local requirements.
27. Website Use
You may use our website for lawful purposes related to browsing, obtaining information, requesting quotations, contacting ERF Shipping, or purchasing our products and services.
You must not misuse our website or interfere with its normal operation.

- Submit knowingly false information

We may restrict access or cancel transactions associated with suspected unlawful or fraudulent activity, subject to applicable law.
29. Intellectual Property
Unless otherwise stated, website content owned by ERF Shipping—including applicable text, graphics, logos, designs, photographs, and other original materials—is protected by applicable intellectual property laws.
Nothing in these Terms grants users ownership of ERF Shipping intellectual property.
30. Third-Party Services
Our website may use third-party services for payment processing, hosting, analytics, transportation, communications, or other business functions.
Those services may be subject to separate terms and privacy policies.
ERF Shipping is not responsible for independent third-party websites that are outside our control.
31. Website Availability
We make reasonable efforts to maintain our website but do not guarantee uninterrupted availability.
Temporary interruptions may occur because of maintenance, updates, technical problems, hosting issues, security events, or circumstances outside our reasonable control.
32. Disclaimer of Warranties
To the extent permitted by applicable law, our website and services are provided subject to the terms, descriptions, warranties, and representations expressly applicable to the transaction.
Nothing in these Terms excludes any warranty, guarantee, consumer right, or remedy that cannot legally be excluded or limited.
33. Limitation of Liability
To the maximum extent permitted by applicable law, ERF Shipping will not be liable for indirect, incidental, special, exemplary, punitive, or consequential losses arising from use of our website or products where such liability may lawfully be limited.
Any limitation in these Terms applies only to the extent permitted by law.
Nothing in these Terms is intended to exclude liability that cannot legally be excluded.
34. Indemnification
To the extent permitted by applicable law, you agree to be responsible for losses or claims arising from your unlawful misuse of our website, violation of these Terms, or infringement of another person’s rights.
This provision does not require a customer to indemnify ERF Shipping for matters for which ERF Shipping is legally responsible.
35. Privacy
Our collection and use of personal information is governed by our Privacy Policy.
Customers should review the Privacy Policy to understand how information may be collected, used, retained, and disclosed.
36. Shipping Policy
Our Shipping Policy forms part of the terms applicable to purchases from ERF Shipping and contains additional information regarding handling, transit, delivery, site access, and transportation.

38. Payment Policy
Our Payment Policy contains additional information regarding accepted payment methods, transaction processing, payment verification, pricing, refunds, and related payment matters.
39. Changes to These Terms
ERF Shipping may update these Terms periodically to reflect changes to our products, website, services, business operations, or applicable requirements.
Updated Terms will be posted on our website with a revised “Last Updated” date.
Changes will apply prospectively except where otherwise permitted or required by law.
40. Severability
If any provision of these Terms is determined to be invalid or unenforceable, the remaining provisions will continue to apply to the extent permitted by law.
41. No Waiver
Our failure to enforce a provision of these Terms on one occasion does not necessarily constitute a waiver of our right to enforce that provision in the future.
42. Entire Agreement
These Terms, together with applicable order details, quotations, and policies incorporated by reference, constitute the agreement governing the applicable transaction, except where ERF Shipping and the customer have entered into a separate written agreement that expressly provides otherwise.
43. Governing Law
These Terms are governed by applicable laws of the State of Florida and the United States, without limiting any mandatory consumer rights that may otherwise apply.
